TERMINATION OF USE

Gaikwad And Sons may, in its sole discretion, terminate or suspend your access to all or part of the Gaikwad And Sons website/ mobile application, including, but not limited to any bulletin boards on its site, for any reason, including without limitation, breach of this agreement. In the event this agreement is terminated, the restrictions regarding materials appearing on the site and the representations and warranties, indemnities, and limitation of liabilities set forth in this agreement shall survive any such termination.

GOVERNING LAW; JURISDICTION AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the Maharashtra of INDIA. The Maharashtra courts shall have exclusive jurisdiction and venue over any dispute arising out of or relating to this Agreement, and each party hereby consents to the jurisdiction and venue of such courts.

Your Own Judgement Needed:

We are intermediate service between tutors & students. We help them to connect either online or offline one on one. Parents, students and tutors need to observe or use their own judgement to take services or continue with their services or continue dealing with each other by using our platform of mobile application and website. We will not be responsible directly or indirectly for any misshapen or affects either party physically, mentally, monetary or any other damages.

REFER & EARN POLICY:

Referring our services & products to any third party or interested party & getting a proper sale means the referred customer actually pays money, you will be entitled with some commission mentioned on the website/ mobile application and you will get paid within a month once the referred party purchased our product or services means we get sale minimum twice. If referred party using our services without paying any service/product charges or using bonus or referral amount or coupon amount or any indirect amount will not be considered as actual sale & you will not get paid any commission for the same Also the final decision of paying commission or incentive for referring customers or any party is reserved with Gaikwad And Sons & they have authority to refuse to pay any commission. They are not bound to entertain any legal/ lawful or illegal force to pay the commission.

REFUND & CANCELLATION POLICY:

In case you want to cancel the contract due to dissatisfaction with our services excluding cases paid party changed mind to take service or not tried our multiple available options or exam got cancelled or any natural disaster happened or changed state/ country or any reason except not happy with our services, Gaikwad And Sons reserves right not to refund the paid amount and no legal/ lawful or illegal force will be entertained to refund the paid amount. For the rest all cases we do have cancellation & refund policies. You will get a refund of unused services/ hours fees by deducting the fees of our use services , platform charges, government taxes if any and nominal cancellation charges. Refund procedure will take a time period of a month or so and after a month's time you will get a refund after all mentioned above deductions. Any transaction done (monetary, physical or any kind of) without our knowledge or without using Gaikwad And Sons mobile application or website by either of the party service gainer and giver , Gaikwad And Sons will not be responsible or liable to answer or sort out issues between both the parties nor liable to pay any refund directly or indirectly even though both the parties continue services only after meeting on Gaikwad and Sons any platform

GENERAL TERMS & CONDITIONS FOR STUDENTS

1. Fill all the details asked while booking the course to get the exact tutor as per requirement.
2. Your tuition will start after 1–4 working days from the date of submission of requirement and fee clearance. After starting the tuitions, in case of dissatisfaction with our tutor, we have a tutor replacement policy.
3. If you are changing your current residence, you must inform us of your changed address well in advance.
4. We are not connected with any board, university, school, or college. We provide coaching only on a personalized/one-to-one basis.
5. During tuition hours, students should not indulge in drinking, smoking, using mobiles, etc. If found doing so, we won't be responsible for poor performance.
6. Our tutors teach with full responsibility, attention, and academic care. If the student does not concentrate, complete homework, or follow the tutor’s pattern, the student and parents will be solely responsible for poor performance.
7. If any work is handed over to the tutor apart from teaching, we will not be responsible for any resulting circumstances.
8. During tuition hours, at least one family member must be present at home with the student. Otherwise, the tuition will not be conducted and we won’t be responsible for the consequences.
9. We provide the best specialized subject tutors who conduct tuition based on the student’s understanding and grasping power.
10. We do not promise to provide tutors from any specific school, college, or university.
11. We do not provide any printed notes from Gaikwad And Sons Institute. You must purchase notes available in the market or as suggested by the tutor, if required.
12. Missed lectures due to tutor emergencies will be covered as per your availability. Lectures canceled from your end will be adjusted occasionally but not regularly.
13. The time required for portion completion or doubt-solving depends on your grasping power and subject knowledge.
14. Direct dealings with tutors are not permitted. If done, you will be responsible for any consequences, including discontinuation, monetary loss, or academic disruption. Gaikwad And Sons ensures tuition continuity due to our large tutor base.
15. If you score good marks or perform well due to our services, we may use your data for promotional purposes.
16. If fees are not paid on the due date, tuitions will be discontinued on the same day and will resume only after clearing dues.
17. The tuition month is counted from the start date, but fees must be paid as per the due date.
18. Training videos are provided to help understand the mobile application. For further assistance, you can contact our representative or tutor.

GENERAL TERMS & CONDITIONS FOR TUTORS

1. Lecture missed at student's place will lead to payment deduction & affects reviews and ratings.
2. Taking extra lectures at student's place will be your own responsibility unless instructed by Gaikwad And Sons Institute.
3. Payment will be done till the last date of the student's exam (as per academic/semester/course pattern), independent of portion/syllabus completion.
4. Advance payment will not be possible under any circumstances.
5. Student improvement and good results will lead to promotion, while poor results may lead to demotion.
6. All payments are fixed at the start of tuition and cannot be changed later. Tutors are bound to continue for the decided period.
7. Minimum requirement: Two lectures per week (1.5 hours each per subject), unless changes are approved by Gaikwad And Sons Institute.
8. Weekly/Chapter tests are mandatory. Tutors must discuss results and improvement plans with students/parents.
9. Maintaining records (Institute sheet/student notebook/mobile app) is compulsory for payment processing.
10. Books borrowed from the Institute must be returned or their cost will be deducted from payment.
11. Direct dealings with students/parents/their references or sharing details with third parties is prohibited for 3 years from joining date.
12. Submission of all documents (ID proof, address proof, qualification certificates, photos) is mandatory within 10 days of joining.
13. Tuition cancellation due to tutor's irregularity/irresponsibility may lead to termination without payment.
14. 15 days advance notice is required for discontinuing tuition or leaving the Institute.
15. All service/student issues must be reported immediately to avoid future complications.
16. Learning both student & tutor applications is mandatory for all tutors.
17. All class/test records must be entered in applications for increments, ratings, and online presence.

GENERAL PROVISIONS

If any provision of this agreement is deemed void, unlawful or otherwise unenforceable for any reason, that provision shall be severed from this agreement and the remaining provisions of this agreement shall remain in force. This contains the entire agreement between you and Gaikwad And Sons concerning your use of the site/ mobile application, and the agreement shall not be modified, except in writing, signed by both parties.
